TERMS & CONDITIONS

This agreement is a contract between the Dealership ("you") and eQuipt Pty Ltd. 

The terms and conditions under which you may purchase products from www.eQuipt.online are set out below. Please read the following terms and conditions carefully before placing your order with eQuipt.
By completing the customer application process and using www.eQuipt.online you acknowledge that you have read and understood these terms and conditions and agree to be bound by the terms and conditions of this agreement.

1) The Agreement
The entire agreement between you and eQuipt for the purchase of goods by you from eQuipt is:
(a) these conditions; and (b) the terms of the order.

The agreement exists between you and eQuipt once eQuipt receives and accepts an order. No obligation to sell or supply the goods will arise until the order is received and accepted. Each order may be accepted by eQuipt at its absolute discretion. Each order is a separate agreement.

2) Purchase Orders and Delivery of Goods
You will place an order with eQuipt by selecting goods, entering your personal and payment details and pressing the "loan” or “purchase” button.
Anyone at the delivery address who receives the goods shall be presumed by eQuipt to be authorised to receive the goods on your behalf.
(a) to the adult person who placed the order, or
If there is no-one at the delivery address at time of delivery. You will need to make alternate arrangements regarding a suitable time with the carrier. You may be required to pay an additional fee. Deliveries will occur between 9am-6pm Monday to Friday. Exact times cannot be given.

3) Risk & Title
Risk and title in the goods passes to you upon delivery of the goods to the delivery address.
If you are not satisfied with the goods you have purchased, you may contact eQuipt at info@eQuipt.online within 7 days of receiving your goods to request a return authorisation (ra).
After 14 days sales are final. All sale items, phone orders and pre orders are final. No price adjustments. No exchange or refunds on sale items.

Returns must be by registered post. EQuipt will not be responsible for return shipping costs nor duty reimbursement in the case of international purchases (other than faulty items).

4) Price of goods and payment
The price you shall pay for the goods shall be the price specified on the website. You also agree to pay the delivery and handling fee including goods and services tax (Australia only) which eQuipt is required to collect from you. You are liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these is necessary to release your order from customs on arrival.
eQuipt prices are subject to variation without notice. The price payable for the goods shall be the price applicable on the date the goods are confirmed as ordered.
(a) payment upon placement of order
You shall pay for the goods at the time you order. Bankcard, MasterCard, visa, American express and PayPal are accepted at eQuipt.

5) Packaging and Labelling of Goods
All goods sent out by eQuipt will be sent out in the most suitable packaging for the item/items purchased/loan to ensure protection of the item.

6) License
You are licensed to use the eQuipt website on your computer for your use in purchasing/loaning goods from eQuipt you acknowledge that you are not permitted to make any other use of the eQuipt website.

7) Intellectual Property Rights
You acknowledge that eQuipt or its related corporations own or are licensed to use all intellectual property rights in eQuipt (including, but not limited to, any images, photographs or text which appears on the website). You agree that you will make no representation to the contrary, and that you must not use or copy eQuipt in any manner which is inconsistent with the rights of the owner or licensee of such intellectual property rights.

You acknowledge that any trademarks or logos which appear on the eQuipt website are owned by or licensed to eQuipt, and that you must not do anything to prejudice the rights of the trade mark owner or licensee to such trademarks or logos.

8) Liability
To the extent permitted by law, you agree that any liability of eQuipt arising out of or in connection with any breach of any express or implied warranty or condition in respect of goods or services supplied to you through use of eQuipt will be limited to:
(a) if the condition relates to goods, the replacement of the goods or the supply of equivalent goods; and
(b) if the condition relates to services, the supplying of the services again or the payment of the cost of having the services supplied again.

You agree that the entire risk arising out of installation, downloading, use or performance of eQuipt remains with you. To the extent permitted by law, you release and discharge eQuipt and its related corporations from all forms of direct, special, indirect or consequential loss or damage (including loss of profits, loss of data or loss or damage that may reasonably have been supposed to have been in the contemplation of the parties as at the date of this agreement) arising out of or in connection with eQuipt or this agreement, including, without limitation, loss or damage caused by the negligence of eQuipt or its related corporations.

9) Security
If you are issued with a password by eQuipt, you agree to take responsibility for the safekeeping of your password. You are liable if an unauthorised person uses your password. You agree to release and forever indemnify eQuipt in relation to any liability howsoever arising out of the unauthorised use of your password.

10) Notification of changes
eQuipt may add to, delete, or otherwise change any of the terms of this agreement. Your use of the eQuipt service will constitute your deemed acceptance of such changes.

11) Privacy
eQuipt are subject to the national privacy principles in the privacy act 1988 (cth). This privacy policy and disclosure statement explains in general terms how eQuipt protects the privacy of your personal information under the national privacy principles. It also sets out the matters, which we are required to disclose to individuals under national privacy principles 1.3 and 1.5. The principles set out in this eQuipt privacy policy and disclosure statement will apply to any personal information you provide to eQuipt via our web site or under any agreement or arrangement and to information, which we collect about you from other sources.
Information Collected
We generally collect your personal information directly from you. For example, when you subscribe to the eQuipt mailing list or enter details to complete your online transaction. Generally, the type of personal information we collect about you includes your name, e-mail address, and the state you live in. eQuipt does not store credit card details.
When you view at this web site, eQuipt may make a record of your visit and logs the following information for statistical purposes:
• Your server address
• Your top level domain name (for example .com.gov.au.uk etc)
• The pages you accessed and documents downloaded
• The previous site you have visited
• The type of browser you are using.
Cookies
Your internet browser has a feature called "cookies" which store small amounts of data on your computer about your visit to any of our sites. However, cookies tell us nothing about who you are unless you specifically give us personally identifiable information. You do not need to have cookies turned on to visit our website. In addition, you may elect not to allow cookies to be collected by selecting certain options on your browser.
Web Bugs
We use electronic images known as web bugs - sometimes called single-pixel gifs, transparent gifs, or clear gifs- that allow us to track general user traffic patterns.

Our Disclosure Statement
eQuipt collects personal information for the following purposes:
• To provide you with information about eQuipt products via email
• To sell you eQuipt products over the internet
• Keeping count of return visits to our site
• Accumulate and report anonymous, aggregate (data collected in mass), statistical information on web site usage
• Determining which pages and features users like best
• Access to information collected

How we use or disclose your personal information
We will not make an attempt to identify users or their browsing activities. However, in the unlikely event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect our internet service provider's logs.

We will use and disclose personal information for the primary purpose for which it was collected. We do not disclose personal information we collect to third parties for the purpose of allowing them to direct market their products and services. We engage third party contractors to perform services for us, which involves the contractor handling personal information we hold. For example, we may engage third party contractors to maintain and monitor our customer and user databases. In these situations, we prohibit the third party contractor from using personal information about you except for the specific purpose for which we supply it.

Gaining access to information we hold about you
We will, on request, provide you with access to the personal information we hold about you unless there is an exception, which applies under the privacy act. Your request to obtain access will be dealt with in a reasonable time. eQuipt may recover from you its reasonable cost of providing you with access. If we refuse to provide you with access to the information, we will provide you with reasons for the refusal and inform you of any exceptions relied upon under the privacy act.

Keeping your personal information up-to-date
We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date whenever we collect or use it. If any of the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will take reasonable steps to correct this information or, if necessary, we will discuss alternative action with you.

Security of your personal information
We protect any personal information that we hold from misuse and loss. We also protect it from:
Unauthorised access, modification and disclosure. Your personal information may be stored either in hard copy documents or as electronic data in eQuipt’s software or systems. We maintain physical security over our paper and electronic data stores and premises, such as locks and security systems. We also maintain computer and network security; for example, we use firewalls (security measures for the internet) and other security systems such as user identifiers and passwords to control access to our computer system.
